1. Introduction & Who We Are
Memory Leaf LLC ("Memory Leaf," "we," "us," or "our") is a Florida Limited Liability Company operating the Memory Leaf mobile application and website (collectively, the "Platform"). Memory Leaf is a private, family-centered social memory platform that allows families and groups to share photos, videos, memories, family trees, messages, and commemorative profiles for loved ones.
By using Memory Leaf, you acknowledge that you have read and understood this Privacy Policy.
2. Information We Collect
We collect information you provide directly, information generated through your use of the Platform, and limited technical information necessary to operate the service.
2.1 Information You Provide
- Account information: name, email address, phone number, password, profile photo, date of birth.
- Content you upload: photos, videos, voice recordings, written memories, family tree entries, memorial profiles, comments, and messages.
- Payment information (processed securely by our payment processor, [Stripe] — Memory Leaf does not store full card numbers).
- Communications you send to our support team.
2.2 Information Collected Automatically
- Device information (device type, operating system, unique device identifiers).
- Usage information (features used, session length, crash logs).
- Approximate location derived from IP address, used only for security and localization.
3. How We Use Your Information
- To create and maintain your account and family groups.
- To display, store, and deliver your content — including scheduled Time Capsule posts — to the family members you designate.
- To process payments and manage subscriptions via [Stripe].
- To send transactional notifications (e.g., "A family member tagged you") and, with consent, marketing updates via [HubSpot].
- To detect, investigate, and prevent fraud, abuse, and violations of our Terms of Use.
- To improve reliability, performance, and features of the Platform.
4. How We Share Information
- With your family group: Content you post is visible only to the specific family/group members and privacy settings you select.
- Service providers: Cloud hosting, payment processing (Stripe), marketing/CRM (HubSpot), and customer support tools, each bound by confidentiality and data protection agreements.
- Legal requirements: When required to comply with a valid legal process, protect the rights and safety of our users, or investigate fraud.
- Business transfers: In connection with a merger, acquisition, or sale of assets, subject to continued protection of your data under this Policy.
5. Legal Basis for Processing (EEA/UK Users)
If you are located in the European Economic Area or United Kingdom, we process your personal data based on: performance of a contract (providing the Platform), your consent (e.g., marketing emails), legitimate interests (security, fraud prevention, product improvement), and compliance with legal obligations.
6. Data Retention
We retain your information for as long as your account remains active, subject to the plan-specific retention rules described in our Account & Data Deletion Policy. Free "Seedling" tier accounts inactive for 24 consecutive months may be deleted per our Terms of Use. Paid tier content is retained as a permanent archive for the life of the subscription.
7. Data Security
We use industry-standard administrative, technical, and physical safeguards designed to protect your personal information, including encryption in transit and at rest, access controls, and regular security reviews. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
8. Children's Privacy
Memory Leaf is intended for users aged [13] and older. Minor family members may be represented in family tree entries or tagged in family content by a parent or guardian, but may not independently create an account below the minimum age. We do not knowingly collect personal information directly from children under the applicable age without verifiable parental consent.
9. Your Privacy Rights
Depending on your location, you may have the right to access, correct, delete, export, or restrict the use of your personal information, and to withdraw consent for marketing communications at any time. To exercise these rights, contact us at privacy@memoryleaf.com or visit our Account & Data Deletion page.
10. Memorial & Deceased User Profiles
Memory Leaf allows family members to create dedicated memorial profiles honoring deceased loved ones and pets. A designated family administrator may manage a memorial profile's visibility and content. We treat memorial content with the same privacy protections as active user content, and it is never used for advertising purposes.
11. International Data Transfers
Memory Leaf is operated from the United States. If you access the Platform from outside the U.S., your information will be transferred to, stored, and processed in the United States, which may have different data protection laws than your country of residence.
12. Cookies & Tracking (Website Only)
13. Third-Party Services
Our Platform integrates with trusted third-party service providers including [Stripe] for payment processing and [HubSpot] for customer communications. These providers have their own privacy policies governing their use of your information.
14. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify users of material changes via in-app notification or email prior to the change becoming effective. Continued use of the Platform after changes take effect constitutes acceptance of the revised policy.
